$500,000: Aguilar, et al v. Martinez

San Diego, California. Wrongful death and emotional distress claims. Two minor children were struck and killed on SR-78 East in Vista, CA as they attempted to retrieve luggage from the #3 lane that had fallen from their vehicle. The mother of the children faced felony charges for her involvement in the incident. The Defendant driver was distracted by her phone and was not paying attention to the vehicles and traffic ahead of her. Despite multiple vehicles slowing down, changing lanes, and avoiding the luggage and children, the Defendant driver never slowed down, did not change lanes, and never saw the children before striking them with her car. After investigation and research, the only applicable policy that covered the loss had per accident limits of $500,000. The policy was tendered to the family of the children.
