David Blain, Esq., is a trial lawyer representing people injured in an accident or by a defective product. He has litigated several hundred injury cases over the last ten years including wrongful death cases and catastrophic injury cases involving brain injury, spinal injury, and orthopedic injury. In the last four years, he has recovered more than $35 Million on behalf of his clients.
In 2023, Mr. Blain secured a confidential settlement in a premises liability lawsuit against a large retail store. Mr. Blain's client was stabbed in a purse snatching while in the parking lot of the retail store. Pre-litigation investigation revealed consistent criminal activity in that parking lot including prior robberies with violence and weapons. A lawsuit was filed against the Defendant retail store and discovery revealed that on the date of the incident, the retail stores security officers, security manager, and security task force leader were all absent. As a result, no safety checks of the parking lot or perimeter were performed, and no person was overseeing the security cameras that surveilled the parking lot. The Plaintiff alleged that the failure to take any security measures on the date of the incident contributed to the occurrence of the attack on the Plaintiff. The case ultimately went to mediation and the parties settled for a confidential amount.
Also in 2023, Mr. Blain secured a $500,000 policy limit settlement for a wrongful death claim in San Diego County and a $500,000 settlement in Orange County for a Plaintiff injured in a rear-end auto collision.
In 2022, Mr. Blain obtained a $1.5 Million Dollar Settlement for a client in San Diego involved in a rollover collision and a $3 Million Dollar Settlement for a client in Los Angeles involved in a motorcycle collision. Both cases involved disputed liability and damages, and each case had over a dozen expert witnesses. Both cases settled after expert discovery and depositions and just prior to commencement of trial.
In 2021, Mr. Blain obtained an $8.5 Million Dollar settlement for a deserving client. It was a motorcycle collision versus a commercial delivery truck. The Plaintiff sustained significant injuries to his head, shoulders, back, wrist, and leg. Mr. Blain litigated the case for nearly two years and secured a life altering settlement for the Plaintiff two weeks before trial was to commence.
In 2020, Mr. Blain obtained an $8 Million Dollar Settlement for a deserving client who was injured in a motor vehicle collision. The Plaintiff was parked on the side of the road when his vehicle was struck by a Defendant who was a car porter for a Los Angeles auto dealer. Plaintiff suffered an injury to his spinal cord and underwent multiple surgeries. The case was litigated for two years before an $8 Million Dollar settlement was obtained for the Plaintiff.
In 2020, Mr. Blain obtained a $2 Million Dollar settlement in a wrongful death action. The decedent was a husband and father of two young children. He tragically passed away while participating in a extreme outdoor event after suffering a sudden medical emergency. After several high profile law firms rejected the case, the firm Mr. Blain was working for accepted it and assigned it to Mr. Blain. Mr. Blain performed the investigation and located key fact witnesses that told a devastating story of how the Defendants had actual knowledge of decedent's physical condition and medical emergency. Shockingly, Defendants not only failed to provide medical attention, they also encouraged decedent to continue with the event. Hours later he died. These witnesses and other evidence helped defeat a defense of waiver and assumption of the risk, and ultimately led to the settlement.
In 2017, Mr. Blain obtained a jury verdict on behalf of his client after a motor vehicle collision. The Defendant made an unsafe and negligent left turn directly into Plaintiff's path of travel. Defendant's insurance carrier (Farmers Insurance) disputed liability and blamed the Plaintiff for the collision. Defendant's insurance carrier also argued Plaintiff was not actually injured and asked the jury to award him $3,001. Mr. Blain was able to prove the accident was 100% the fault of the Defendant and that Plaintiff was injured and needed the medical treatment that he underwent. The jury agreed with Mr. Blain and awarded the Plaintiff more than $30,000. After the verdict, Mr. Blain brought motions for costs and attorney's fees which the judge granted. In total, Mr. Blain was able to obtain a judgment in Plaintiff's favor of more than $50,000.
Mr. Blain earned a scholarship to attend Whittier Law School, where he earned his Juris Doctorate in 2010. While in law school, Mr. Blain was on the Dean's List and earned the CALI Award (highest score) in Federal Income Taxation and Antitrust Law. Prior to law school, Mr. Blain attended Azusa Pacific University where he was a scholar-athlete as a four year member of the football team. He graduated in 2006 with a Bachelor of Arts degree in Business Administration and as a member of the Dean's List.
Mr. Blain is married to his lovely wife Molly and they live in San Juan Capistrano with their four children (Colton, Wyatt, Avery, and Beau). In his spare time, Mr. Blain enjoys being outdoors, sports, reading, and spending time with his family.
