Orange County. Auto v. bicyclist. The Plaintiff was riding her bicycle home from work in the bike lane when the Defendant made an abrupt right turn into the bike lane and struck the Plaintiff. The Plaintiff fell to the ground and hurt her shoulder. The Plaintiff ultimately was diagnosed with a rotator cuff tear and underwent surgery. The Defendant's auto insurance carrier (State Farm) initially denied liability and blamed the Plaintiff for the accident. Blain Law APC was hired and we investigated the collision, located a witness and obtained her statement. The witness statement corroborated the Plaintiff's statement and we were able to convince State Farm to reverse their liability determination. State Farm tendered the $100,000 policy limits to settle the Plaintiff's claim in pre-litigation.
