$100,000: Broos v. Kwan

San Mateo County. T-bone collision. Disputed liability. The Plaintiff was driving to work early in the morning and while making a left turn onto a main street he was T-Boned by the Defendant's vehicle. The Plaintiff was seriously injured including four broken ribs and a collapsed lung that required a two-day hospital admission. The Defendant and Plaintiff each claimed they had the green light and the other driver had the red light. Defendant's insurance carrier, State Farm, disputed liability and the best pre-litigation offer it made to the Plaintiff was $6,000.
Blain Law, APC, filed a lawsuit and conducted discovery. Mr. Blain took the deposition of the Defendant driver and secured his version of the collision under oath. Discovery also revealed that the incident was captured on video, so we issued a subpoena. The video showed the light facing the Defendant turned red three seconds before the Defendant entered the intersection. It also showed the Defendant was speeding and accelerating to try and beat the light. Mr. Blain was able to show that the Defendant was 100% at fault for the collision and that he lied about his responsibility.
The case settled for State Farm's $100,000 liability limits.
