$50,000 Judgement After Jury Verdict: Raymond Franco v. Eric Thomas

San Bernardino County. Car accident. Plaintiff was driving through Auto Center Drive on a green light when Defendant made an unprotected left turn and crossed over Plaintiff's lane. A collision ensued. Moderate injuries included neck pain, shoulder pain, and back pain. MRI of the lumbar spine revealed a dis bulge of about 3mm that was non-surgical. Treatment included chiropractic therapy, orthopedic consultation, and MRI. No epidural injection was provided and the disc bulge was non-surgical.
Defendant's insurance company (Farmers Insurance) disputed liability, disputed Plaintiff's injuries and medical treatment, and disputed the value of the claim. Plaintiff's medical bills totaled about $10,000. Plaintiff served a CCP section 998 settlement offer of $17,500. Defendant offered $3,000 pre-trial and $8,000 on the second day of trial. The case went to the jury which returned a verdict of $31,000. A judgment of more than $51,000 was entered after costs and attorney fees were added.
