$100,000: Tibbitts v. Uber

San Diego County. Auto versus pedestrian accident. The Plaintiff and her husband ordered an Uber and when it arrived the husband opened the front passenger door and sat down. The Plaintiff went around the back of the vehicle and opened the rear passenger door on the driver's side and before she got in the vehicle the Uber driver took off. The Plaintiff's foot was run over by the vehicle and she fell to the ground and landed on her backside. The Plaintiff suffered a crush injury to her left foot with nerve damage and back pain. She underwent chiropractic treatment, obtained an MRI, and received an ESI in her lumbar spine. The initial offer was $4,000. The pre-litigation attorney referred the case to Blain Law, APC. The case was litigated for about 12 months and then a settlement of $100,000 was obtained on behalf of the Plaintiff.
