$1.5 Million. Smith v. Schaeffer

October 2021

San Diego County. Rollover car accident. Plaintiff was a passenger in a car travelling down the road in Temecula, California. Defendant pulled out of a private parking lot and crossed directly into Plaintiff's lane of travel. A collision ensued and Plaintiff's vehicle rolled over and landed on its roof. Plaintiff suffered a burst fracture of the T12 vertebrate, aggravation of a degenerative condition in her neck and back that resulted in chronic pain. The trauma of the car accident and the chronic pain also caused Plaintiff to experience significant depression and mental health disorders. Defendant offered $450,000 to settle the case after the second mediation. The parties answered ready for trial but it was delayed several times due to the COVID pandemic. It ultimately settled for $1.5 Million two days before trial was set to begin.
